Privacy Statement
At the Adelaide Convention Tourism Authority (ACTA) we are committed to protecting the privacy of personal information which you may provide to us during the course of our business relationship. We believe that respect for individual privacy forms part of the ongoing trust we wish to develop with our members, clients, suppliers and staff.
ACTA is bound by, and committed to supporting, the National Privacy Principles (NPPs) as set out in The Privacy Amendment (Private Sector) Act 2000 (Commonwealth). Our aim is to ensure that we comply with the NPPs that form the basis of laws introduced to strengthen privacy protection for the general public. As such, our policy aims to alleviate any potential concerns you may have about how we store, use and access the personal information you may provide to us.
ACTA staff are required to respect the confidentiality of personal information and the privacy of individuals and are committed to accepting and adopting this policy.
Definitions
Personal information is information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion. Personal information relates to individuals, not companies.
Sensitive information
means: information or an opinion about an individual’s – race or ethnic origin; political opinions; membership of a political association; religious beliefs or affiliations; philosophical beliefs, membership of a professional or trade association; membership of a trade union; sexual preferences or practices; criminal record; or, information about the health or disability of an individual.
Overview
ACTA is a private, non-profit membership based organisation that facilitates wealth generation for the meetings and tourism sectors thereby contributing to the economy of South Australia. ACTA’s role is to promote South Australia as a prime convention, incentive travel and exhibition destination. Its members are professional businesses that represent every aspect of the tourism, meeting, incentive, exhibition and travel industry.
1. Collection of Personal Information
ACTA may collect personal information (primarily contact details) in order to conduct our business and fulfil its obligations to members and clients in supplying marketing services or to suppliers who are supplying ACTA with goods and services.
This information may have been collected in person, on business cards, entered on our website, or provided to us in a registration or other administration process, and from third parties.
ACTA will not collect personal information unless it is required for the purpose of undertaking our activities and functions. Any information collected will be done in a fair and non-intrusive manner.
In general, ACTA does not collect sensitive information from individuals. However, if it is necessary and we do so we will make the individual aware of the purpose of such collection and obtain consent to do so.
2. Use and Disclosure
ACTA’s primary purpose in collecting personal information is to enable us to fulfil our main (primary) purpose to you in facilitating, creating and securing business for the Business Events and Leisure Tourism sectors.
In general, we use and disclose your personal information for the following purposes:
To conduct our business;
To carry out marketing initiatives and market analysis;
To communicate with you;
To purchase from you;
To comply with our legal obligations; and
To help us manage and enhance our services
This will enable us to fulfil our commitments and responsibilities to members and to enable them to reap the full benefits of membership.
We may disclose your personal information to:
Members of ACTA;
Other companies or individuals who assist us in providing services;
Anyone else to whom you authorise us to disclose it.
ACTA will not, without your consent, disclose personal information for any purpose (secondary) other than for the main (primary) purpose of fulfilling our business commitments to you, except where:
1. it is required or authorised by law or for purposes of law enforcement;
2. the secondary purpose is related to the primary purpose and there is a reasonable expectation that we would use or disclose the information in the circumstances;
3. ACTA reasonably believes it is necessary to prevent any serious and imminent threat to any person’s life, health or safety.
4. ACTA will not otherwise disclose your personal information to any other party without your consent.
Sensitive information will be used and disclosed only for the purpose for which it was provided or a directly related secondary purpose
3. Accuracy of Data
ACTA endeavours to ensure that the personal information it holds is accurate, complete and up-to-date. This is the responsibility of all staff involved in the collection and recording of such information. We encourage you to contact us in order to update or correct any personal information we hold about you.
4. Data Security
ACTA takes reasonable steps (within our financial means) to protect the personal information it holds from misuse and loss and from unauthorised access, modification or disclosure by use of physical security as well as restricted access to electronic records. Internally, ACTA restricts access to personal information to employees or parties who need access to information in order to undertake to their work. These employees or parties are committed to maintaining confidentiality.
Where we no longer require your personal information, we will take reasonable steps to destroy it or permanently render it anonymous.
If at any given time you choose not to receive information from us, we will delete your details from our distribution list upon written request.
5. Access and Correction
You have a right to seek to access the personal information ACTA holds about you (subject to the exceptions set out in the Privacy Act). We encourage you to advise us if you believe that the information is inaccurate, incomplete or out-of-date. Our contact details are set out below. We will require you to verify your identity and to specify what information you require. ACTA will respond to requests for access to personal information within 14 days of receipt of a written request.
6. Use of Identifiers
ACTA does not use any other agency’s identifiers such as tax file numbers as a means of identifying a person from whom the information has been collected.
7. Anonymity
Wherever it is lawful and practicable, ACTA will endeavour to provide you with the option of not identifying yourself or not providing personal information when entering transactions with us. However, failure to provide the full and complete information we request may result in a limited ability on our part to offer or deliver complete services to you.
8. Sending Information Overseas
ACTA will only transfer personal information to foreign countries: - after reasonable steps have been taken to ensure that the foreign recipient will deal with the personal information in a manner that is consistent with the NPPs or equivalent privacy laws; the individual consents (in some cases this consent will be implied); the transfer is necessary for the performance of a contract been ACTA and the individual or is in the interests of the individual.
